Terms of Use

These terms are the agreement between you and YORKER AI for the YORKER AI iPhone app and the website at yorkerai.com. By continuing past the sign-in screen, you agree to them. If you don't agree, please don't use the app.

1. Who we are

YORKER AI is the trading name of Shivam Panday, a sole trader in the United Kingdom. In these terms "we", "us" and "our" mean that business, and "you" means the person using the app.

Our PrivacySupport explains how we handle your personal data. It forms part of these terms.

2. Who can use YORKER AI

• You must be 13 or over to create an account.
• If you're under 18, you need a parent's or guardian's permission to use the app and to subscribe.
• Your account is for you alone. Keep your sign-in secure, and tell us straight away if you think someone else has used it.

3. How we use AI

We use AI, including generative AI, to enhance the experience of our features. To do this, we and our AI providers analyse your recordings, including the people in them and how they move. Some of this processing may happen outside the UK. By continuing past the sign-in screen, you give your explicit consent to this.

You can withdraw your consent at any time by emailing support@yorkerai.com. Withdrawing doesn't affect anything done before, but some features may stop working for you.

4. Recording other people

• You must have the permission of everyone you record, including the bowler, the batter and anyone else in the shot.
• For anyone under 18, you need a parent's or guardian's permission, or the club's where the club has it.
• Follow your club's or ground's photography and safeguarding policies.
• Our AI analyses the people in your clips, so make sure they know you use YORKER AI.

5. Community rules

We have zero tolerance for objectionable content and abusive users. Don't use YORKER AI to:

• share sexual, violent, hateful, abusive or illegal content;
• harass, bully, threaten or demean anyone;
• put a child at risk;
• record people without the permission in section 4;
• pretend to be someone else;
• interfere with the app, our systems or other people's accounts.

To report content or a user, use Report in the app or email support@yorkerai.com with "Report" in the subject line. You can also block a user so they can no longer see you or contact you. We act on every report within 24 hours. We remove content that breaks these rules, and we can suspend or remove the account of anyone who posts it or abuses others.

6. Your content

Your recordings, measurements and tags belong to you. You allow us to store and process them only to run YORKER AI, show them to the people you choose and improve our ball tracking, as described in the PrivacySupport. You're responsible for what you record and share.

7. Measurements are estimates

Every speed and measurement is an estimate, worked out from your iPhone's camera. YORKER AI isn't a certified measuring instrument, and accuracy depends on where the phone is, the light and the setup. Measurements are not official decisions. Don't rely on them for umpiring, selection, records, betting or medical decisions.

8. Training safely

Cricket balls are hard and can cause serious injury and damage. Put your phone and tripod well out of the line of the ball, make sure the setup can't be knocked over, and follow the supervision and rules at your club or ground.

9. Subscriptions

• Your first month of full access is free. It starts when you record your first session, and then your account moves to the free plan unless you subscribe.
• Subscriptions are bought, renewed and cancelled through Apple. Apple takes the payment, and we never see your card details.
• The price, the length of any free trial and the renewal period are shown before you buy. A subscription renews automatically unless you cancel it at least 24 hours before the end of the current period.
• To cancel, open Settings on your iPhone, tap your name, then Subscriptions. For refunds, go to reportaproblem.apple.com.
• Deleting your account doesn't cancel a subscription. Cancel it with Apple first.

Apple's Standard Licensed Application End User License Agreement also applies to your use of the app.

10. Deleting your account

You can delete your account in the app from your Profile, or by emailing support@yorkerai.com. The deletion takes effect 7 days after you ask. If you sign back in within those 7 days, you can restore your account and nothing is lost. After that, your account and everything in it are deleted for good.

We can suspend or close your account if you break these terms, and we'll tell you why unless the law or safety stops us.

11. Changes to the app

We keep improving YORKER AI, so features may change, be added or be removed. We try to keep the app running at all times, but we can't promise it will always be available or free of faults. Uploading clips and some features need an internet connection.

12. Our responsibility to you

Nothing in these terms limits or excludes any liability that UK law doesn't allow us to limit or exclude, including for death or personal injury caused by our negligence, or for fraud. Nothing affects your statutory rights as a consumer.

Subject to that, and as far as UK law permits:

• we aren't responsible for loss or damage that wasn't foreseeable when you started using the app;
• YORKER AI is for personal use, so we aren't responsible for business losses, such as lost profit or lost opportunity;
• we aren't responsible for delays or failures caused by events outside our reasonable control;
• our total liability to you is limited to the amount you paid for YORKER AI in the 12 months before the claim.

13. Changes to these terms

We'll update these terms when the app or the law changes. If a change affects you significantly, we'll tell you in the app or by email before it takes effect. The version at the top shows when they last changed.

14. The law that applies

These terms are governed by the law of England and Wales. You can bring a claim in the courts of England and Wales, or of Scotland or Northern Ireland if you live there.
